These Terms of Use ("Terms") govern your use of the Sharpify mobile application (the "App"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.
1. The Service
Sharpify is an attention-training app that uses your device's TrueDepth camera and ARKit to measure your visual focus during timed sessions. Sharpify is intended for general wellness and self-improvement purposes only. It is not a medical device and does not diagnose, treat, cure, or prevent any condition. Consult a qualified professional for medical advice.
2. Subscriptions — Sharpify Monthly
Sharpify offers a 7-day free trial that begins when you first open the App. After the free trial ends, continued use of the App requires an active Sharpify Monthly subscription.
Auto-renewable subscription terms:
- Title: Sharpify Monthly
- Length & price: 1 month for $4.99 USD (or the equivalent in your local currency).
- Free trial: The App provides a 7-day free trial that begins the first time you open it. No payment is required during the trial. When the trial ends, an active subscription is required to continue using the App.
- Auto-renewal: Payment is charged to your Apple ID at confirmation of purchase. Your subscription automatically renews for the same period at the same price unless it is cancelled at least 24 hours before the end of the current period.
- Renewal charge: Your account is charged for renewal within 24 hours prior to the end of the current period.
- Managing & cancelling: You can manage or cancel your subscription at any time in your App Store account settings after purchase. Cancellation takes effect at the end of the current billing period.
Prices are set for your local currency by Apple and may vary. Subscriptions are billed and managed by Apple through your Apple ID. All purchases are final except as required by applicable law; refunds are handled by Apple in accordance with the App Store terms.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on Apple devices that you own or control, as permitted by the Apple Media Services Terms and the standard Apple End User License Agreement (EULA).
4. Acceptable Use
You agree not to: (a) copy, modify, reverse-engineer, or create derivative works of the App except as permitted by law; (b) use the App for any unlawful purpose; or (c) interfere with or disrupt the App's operation or security.
5. Safety
Do not use the App while driving, walking in traffic, or in any situation that requires your full attention. Take breaks and stop if you experience eye strain or discomfort.
6. Intellectual Property
The App, including its design, text, graphics, and software, is owned by Sharpify and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.
7. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that focus measurements will be accurate in all conditions.
8. Limitation of Liability
To the maximum extent permitted by law, Sharpify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of or inability to use the App.
9. Apple's Role
These Terms are between you and Sharpify only, not with Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Maintenance and support of the App are our responsibility, not Apple's.
10. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted, indicated by the "Last updated" date above. Your continued use of the App constitutes acceptance of the updated Terms.
